PERSONAL DATA PROTECTION – Fundamental Right – PEC 17/19

On August 31, 2021, the House of Representatives (Câmara dos Deputados) approved the Proposal to the Amendment of the Federal Constitution no. 17/19 (“PEC”), which includes the protection of personal data as a fundamental right in Article 5 of the Brazilian Federal Constitution. Additionally, the PEC determines it will be the responsibility of the Federal Union to legislate on the subject of data protection and processing.

The significance and concern with the subject of personal data protection are clear in the fact that the PEC was approved by Federal Deputies by 439 votes to 1 vote in the first round and by 436 votes to 4 votes in the second round.

The PEC will now be forwarded for consideration to the Senate.
